Nagpur Nagarik Sahakari Bank Ltd. (“Bank” / “our” / “we” / “us”) is strongly committed to protect the privacy of its users personal information and sensitive personal data or information, including information that is of a confidential nature (“Customer Information”) belonging to the customers, potential customers, and other users of the Services (“Customer/s”/ “Users”) and has taken all necessary and reasonable measures to protect the confidentiality of the user information and its transmission through its Digital Platform and it shall not be held liable for disclosure of the confidential information when in accordance with this Privacy Commitment or in terms of the agreements, if any, with the users.
Applicability:
This Privacy Policy (“Policy”) is applicable to all the services availed via our
Digital platforms including website (https://www.nnsbank.co.in), Internet
Banking service, all mobile banking applications and /or all online services,
the mobile site/applications offered by us or other point of sales, third party
platforms, or through communications, by electronic means or otherwise, or
any other mode / Platform, with regards to subscription, refunds or
cancellation policy or any other Policy introduced by us from time to
time (“Services”).
2. What information does the Bank collect:
Bank may collect, receive, possess, store, use, deal, handle, transfer, retain
and otherwise process Customer information which may include Customer
name, signature, email addresses, phone numbers addresses, KYC/identity
documents as may be prescribed by Regulatory Authorities from time to time
(Biometric data (information such as your fingerprint, etc which you choose to
provide to the Bank for authentication and fraud prevention purposes and the same will not be used without the user’s explicit consent.), communications
with the Bank, device and location data (which includes information that may
be collected by certain mobile applications which identify your physical
location. This information may be collected from your mobile device’s location
aware features when the user requests certain services that are dependent on
your physical location, information about how you use our Services, financial
information etc.
3. For the purpose of this Policy:
“Digital Platform” shall include our mobile
application i.e. NNSB Applications, white-label applications, or any other
applications for iOS, Android, or any other web browser services, developed
by/for third parties like Internet Banking, NNSB Mobile Banking app and
Unified Payments Interface (UPI - PSP ), applications from through Bank’s or
any merchant’s or TPAP’s channel or application, that the Bank as a PSP
Bank received transaction data and POS devices or any other application,
software, Payment Gateway, etc. which may be developed or hired by the
bank from time to time
4. Personal Data:
Personal Data may be classified as Personal Data –
personally identifiable information, Sensitive Personal Data or information and
Non-Personal information which is described as follows:
i. “Personal Data” – (Personally identifiable Information) refers to data that
identifies (whether directly or indirectly) a particular individual, such as
information you provide on our forms, surveys, online applications or similar
online fields. Examples may include your name, previous names, postal
address, email address, telephone number, date of birth or account
information.
ii. “Sensitive Personal Data or Information” – Information such as user’s
occupation (whether self-employed or employed by someone) and financial
situation, name and address of the employer, the nature and volume of
anticipated business dealings, with the conventional bank licensee, income proof, bank statements, income tax returns, salary slip, contract of
employment, passbook, debit/credit card details, expenditures, assets and
liabilities, source of wealth, signature, as well as other bank account details
Sensitive Information also refers to the Financial information such as Bank
account or debit card or other payment instrument details; passwords;
Government issued Identification documents such as AADHAAR, Pan
Number, Driving License etc.. Provided that, any information that is freely
available or accessible in public domain or furnished under the Right to
Information Act, 2005 or any other law for the time being in force shall not be
regarded as sensitive personal data or information for these purposes.
Sensitive Personal Data such as gender, medical records and history of the
user; Personal Data that users provide to the Bank about others or others
provide to the Bank about the user.
iii. Non-Personal Information –It is the information that cannot be used to
identify the user such as the webpages that the user might have viewed and
other usage patterns.
iv. Transaction Data – Data we collect when you make financial and non-
financial transactions. Data may include information associated with the
transaction such as amount sent or requested, amount paid for products or
services, merchant information, including information about any funding
instruments used to complete the transaction, Device Information, Technical
Usage Data, and Geo-location Information. Generation and storing user
password/s or PIN in an encrypted format based on user request on our
Digital Platform;
v. Device Information –Contact lists (in some cases), technical data about your computer and mobile device including details regarding IP address, applications and usage details.
Use of our Digital Platform shall mean visiting an Digital Platform owned and
/or controlled and/or operated by or for the Bank including to access your
accounts, conduct online transactions, etc.; viewing or clicking on our advertisements, posts, on third party sites that redirect you to our Digital
Platforms; interacting with us on third party sites, etc.
vi. Other information
* User’s photographs;
* Social relationship details such as name of user’s father, spouse, or
mother;
* Behavioral details as to how the user utilises the Bank’s products,
services, offers, etc, as well as the browsing action, online patterns and
activity of the user;
* Records of correspondence and other communications between the
Bank and the user, including email, telephone conversations, live chat,
instant messages and social media communications containing
information concerning user’s grievances, complaints and dispute;
* And any other information as may be required under regulatory
guidelines issued from time to time
5. How is the data collected:
* Based on the information of the devices the user uses to interact with
the Bank, the Bank uses information (including location information)
about such devices used for interaction.
* When a user provides his/her personal information in applications
and/or surveys or other similar fields;
* The telephonic conversation exchanged between the user and the Bank
may be recorded by the Bank; such recordings may be used for quality
purposes, assessing and analysing for improving our services, training
our employees, managing risk and/or to prevent commission of any
fraud or crime.
* The information that you provide, subject to disclosure in accordance
with this Policy and Terms of Service, shall be maintained in a safe and
secured manner. Banks databases and Information are stored on
secured servers with reasonable security measures being implemented
6.Purpose of collecting your Personal Data:
* To offer our products and/or services to the user which the user may
have applied for or displayed interest in;
* he data that we collect helps us to know whether the user is eligible for
the products and/or services offered by the Bank;
* In order to provide the user with products or services that the user has
requested such as, fulfilling a payment request or any other transaction
* he Personal Data that the Bank collects helps the user to apply to the
products offered by the Bank such as prequalifying for a loan, credit
card, opening an account, insurance or any other financial product
offered by the Bank;
* By collecting the user data, the Bank can respond to the user’s
enquiries and/or queries and address the requests made by the user;
* The Bank endeavours to personalise user’s experience on our Digital
Platform;
* To deliver marketing communications that may interest the user;
* To inform any important information with respect to our Digital Platform,
any change in the terms and conditions and/or policies and/or other
relevant administrative information;
* In order to perform our obligations under the KYC norms (e.g. sharing
user information with third parties to verify details provided by the user
to the Bank such as, your identity, in view of authenticating the user and
verifying user information;
* Your personal data allows the Bank to, perform activities such as,
audits, usage trends and improving our products and services,
enhancing the Digital Platform;
* Your personal data also allows us to detect, prevent and control fraud,
in accordance with the prevailing laws and regulations and to comply
with any other legal process and/or law enforcement requirements;
* In order to allow the user to utilise the features on our Digital Platform
by granting us access to the information from user device such as
contact lists or geo-location, when you request certain services from the
Bank;
* To use in other ways. in accordance with the law or with the consent of
the user as required or permitted;
* With a view to manage Bank’s relationship with you;
* In order to prevent and/or detect any crime such as, financing terrorist
activities and/or human trafficking;
* For security, business continuity and risk management;
For protection of any legal rights and in compliance with any legal
obligations;
* For system and/or product development and planning, audit and
administration, etc;
* For the purpose of entering into any contract with the user and/or to
take steps pursuant to user’s request prior to entering into any contract;
* In view of meeting the legitimate interests to be pursued by the Bank or
a third party;
* In order to evaluate the user with respect of the products and/or
services and the referred products;
* For the purpose of scrutinising user’s credit score and other credit
information with a view to share the said information with credit
information companies, for the purpose of offering cross-sell services
and products of the Bank and offering the same to you through various
third-party merchants or service providers with whom the Bank has a tie
up
7.With whom the Data is shared:
* Statutory and regulatory bodies and/or authorities including but not
limited to RBI or the Securities and Exchange Board of India (Including
Central and State government);
* Law enforcement authorities, entities, persons to whom or before whom
it is mandatory to disclose the personal data as the applicable laws for
the time being in force, courts, judicial and quasi-judicial authorities
and/or tribunals, arbitral tribunal.
* In an effort to provide the user enhanced services, the Bank may share
such user information with its Subsidiaries and/or affiliates and/or third-
party service providers and/or processors of information, in accordance
with permissible laws and regulations;
* Third party to comply with legal requirements such as demands of
applicable warrants, court orders for the purpose of verifying or
enforcing our terms of use, other rights, or any other applicable policy of
the Bank to address fraud, security or technical issues, or otherwise to
protect the rights or security of the users or third parties;
8. Personal data of children:
* The Bank ensures that no personal data with respect to a child shall be
processed by the Bank without the parental/ guardian consent of such
child. Further, no data that is likely to cause any harm to a child shall be
processed;
* No tracking and/or behavioural monitoring of a child shall be undertaken
by the Bank;
* No targeted advertising directed at children shall be undertaken by the
Bank.
9.Retention of Customer Information:
Bank may retain the Customer information for as long as required to provide
the user with the Services in accordance with applicable laws and our internal
policies, such as managing the user account and dealing with any concerns
that may arise, or if required for compliance with any legal or regulatory
requirements, or for the institution, enforcement, or defence of legal claims.
Bank may also retain the Customer Information where we need to use it for
our business and related purposes, including but not limited to, responding to
queries or complaints, fighting fraud and financial crime or pursuant to
contractual obligations. If we do not require the retention of Customer
Information, we use best efforts to destroy or delete such Customer
Information as per Regulatory guidelines
10.Right to correction and erasure of your personal data:
The user may approach the Bank to have his Personal Data corrected,
updated or erased. Upon receiving the request from the user for correction,
updation, or deletion the same would be corrected, updated, or erased as per
the user’s request in accordance with the prevailing law and regulations.
11.Updating your information:
Bank will endeavour to keep all Customers Information as updated as
possible. It is therefore required that all users provide accurate information to
Bank and also notify all changes, inaccuracies, incompleteness or errors
found in their information lodged with the Bank in a timely manner.
12. Third party links:
i. Clicking on certain links on our Digital Platforms may redirect you to
another website, or may display information which the Bank has no
connection with. Such websites may contain sensitive information
and/or terms of conditions, privacy or confidentiality provisions that may
differ from our terms and conditions. Such links are provided for the
convenience of the users and should not in any manner be construed to
be any sort of endorsement with regards to its service, content, etc.
* Please note that the bank assumes no responsibility or liability in any
manner for the content, accuracy, reliability or opinions expressed on
such websites which are linked to our Digital Platforms. Such websites
are neither monitored nor investigated or checked for accuracy by the
Bank. The user assumes complete responsibility to evaluate the
accuracy, reliability, timeliness and/or completeness of the information
provided and/or displayed therein. All products, services and content
obtained from a linked site are provided as is without warranty of any
kind, express or implied, including but not limited to, implied warranties
of merchantability, fitness for a particular purpose, title, noninfringement,
security or accuracy.
13. Protecting the User Data:
The Bank endeavours to safeguard and ensure the security of the Customer
information using appropriate measures to protect it from unauthorised access
and follow standards prescribed by applicable law. Bank uses appropriately
secure encryption for the transmission of Customer Information. At the same
time to ensure the security of the Customer Information, the User would be
required to co-operate with the Bank. It is recommended that the users
necessarily choose their passwords carefully and shall not disclose the same
to anyone or keep any written or other record of the password such that a
third party could access it, Bank undertakes not to disclose the information provided by the Users to any person, unless such action is necessary under
any legal requirement or to protect and defend the interest or property of the
Bank or in the case of any act to protect the interest of the Bank, its affiliates
or its members, constituents or of the other persons associated with the Bank.
The Users availing the services of the Bank also undertake not to disclose to
any other person, in any manner whatsoever, any information relating to the
Bank of the confidential nature obtained in due course of availing the services
through the Digital Platforms of the Bank. Failure to comply with this obligation
shall be deemed to be a serious breach of terms herein and shall be entitled
to the termination of the services without prejudice to any damages.
14.Cookies:
The term “Cookies” means small files placed on your hard-drive that assists
us in providing our services by analysing the user behaviour. Bank use data
collection devices such as “Cookies” on certain pages of the Site to help
analyse our web page flow, measure promotional effectiveness, and promote
trust and safety. Cookies can also help us provide information that is targeted
to your interests. You are always free to decline our cookies if your browser
permits, although in that case you may not be able to use certain features on
the Site. Additionally, you may encounter “Cookies” or other similar devices on
certain pages of the Site that are placed by third parties. The website keeps
track of the pages a user may visit by appropriately capturing the IP
addresses, browser information etc. using Cookies. Bank is not liable if the
Cookies are used by advertisers or any other third parties when user visit
Bank website or mobile application from other sites or if user visit another site
after visiting Bank website/mobile application.
15. Subscription Management and Cancellation:
Upon subscribing to the Digital Products of Nagpur Sahakari Bank Ltd. the
Customer hereby accepts the terms and conditions describing the products
and in accordance thereto accepts the following:
i. Payments: In consideration of the Services and the usage of the
Product, the Customer shall pay the fees as per the agreed terms and
conditions as specified in the respective application form duly accepted
by the Customer and notified to the Customer from time to time.
ii. Cancellation and refund requests: In the event, if the payment
against Invoices has not been made by the Customer within the
stipulated time, the services intended to be availed by the Customer
shall be discontinued. All requests for cancellation of subscription and
refund should be raised only via the customer support helpline/Toll
Free Number provided. Cancellation and refund requests raised
through any other mode of communication will not be considered for a
refund.
The user authorizes the Bank to exchange, share, part with all
information related to the details and transaction history of the users to
its Affiliates / banks / financial institutions / credit bureaus / agencies /
participation / service providers in any telecommunication or electronic
clearing networks as may be required by law, customary practice, credit
reporting, statistical analysis and credit scoring, verification or risk
management and shall not hold Bank liable for use or disclosure of this
information.
16. Updating the Policy:
Bank may periodically review and update this Privacy Policy, by using our
services after such update, the User consents to updates made to this Privacy
Policy. We encourage the user to read this Privacy Policy for the latest
information on our privacy practices
17. Authority:
The Board of the Bank has approval for this policy. Any change to the Policy
shall be effective only after approval of the Board.
18. User’s acceptance of this Policy:
User’s acceptance of this Policy: The Bank respects user’s wishes. By using
or visiting this Site and/or using any of the Bank’s application, the user
signifies his assent to this policy. In the event the user disagrees with any ofterms and/or conditions contained in this policy, the user is advised not to use
this site or any applications of the Bank.
